The personal data provided through the Website and the App will be processed by FiextApp for the following purposes:
- To manage inquiries made by business users through the Website contact forms.
- To manage the registration of companies interested in FiextApp’s services and, where applicable, the pre-contractual steps arising from their request.
- To manage user registration in the App, their user account, and access to the available functionalities.
- To allow the User to search for events or tickets, make purchases, and manage operations related to such purchases.
- To allow the User to publish photographs or other content on their profile or in relation to events they have attended.
- To send commercial communications about products, services, news, promotions, offers, events, or updates related to FiextApp, where the User has requested or authorized them.
- To analyze the use of the Website and the App through Google Analytics, for statistical purposes and service improvement, provided that the User has given consent where legally required.
The User’s data will be retained for the following periods:
- Inquiries submitted through contact forms: for as long as necessary to handle the request and thereafter for a maximum of 2 years, unless they must be retained due to a legal obligation.
- Company registration requests: for as long as necessary to process the request and thereafter while liabilities may arise or the information must be retained for administrative or legal reasons.
- App user account data: while the User keeps their account active and, once closed, for the period necessary to address possible legal or contractual liabilities.
- Purchase-related data: for as long as necessary to process the purchase and for the retention periods required by the applicable tax, accounting, and consumer regulations.
- Photographs or content published by the User: while they remain published or until the User deletes them or requests their deletion, without prejudice to their blocked storage where necessary for the establishment, exercise, or defense of claims.
- Commercial communications (newsletter): while the User remains subscribed or until they withdraw consent; in any event, they may be deleted if there is no interaction for a maximum period of 3 years.
- Data processed for analytics purposes: for the period established by Google Analytics or until the User withdraws consent, where such consent is the lawful basis.
WHAT PERSONAL DATA DOES FiextApp PROCESS?
FiextApp may process, depending on the case, the following categories of data:
- Identification data: name, surname, company name, username.
- Contact data: email address, telephone number, and any other data provided through forms or during registration.
- Account data: access credentials, user identifiers, and data required to manage the profile.
- Transactional data: information related to the search, reservation, or purchase of tickets and to operations carried out through the App.
- Content provided by the User: photographs, comments, or other materials published through the App.
- Browsing, usage, and analytics data: information about interaction with the Website and the App obtained through cookies, SDKs, or similar technologies, including Google Analytics where applicable.
WHAT IS THE LAWFUL BASIS FOR PROCESSING THE USER’S DATA?
The processing of the User’s data by FiextApp is based on the following legal grounds:
- For handling inquiries submitted through the Website contact forms and for managing company registration requests: the implementation of pre-contractual measures at the request of the data subject and, where applicable, FiextApp’s legitimate interest in properly handling the requests received, following the balancing of interests carried out by FiextApp.
- For user registration in the App, account management, ticket search, purchases, and the provision of services offered through the App: the performance of the contractual relationship between the User and FiextApp or the implementation of pre-contractual measures requested by the User.
- For the publication of photographs or other content by the User: the performance of the contractual relationship with respect to the App’s own functionalities and, in relation to content the User decides to publish voluntarily, their own act of publication and, where required, their consent.
- For sending commercial communications: the User’s consent, which may be withdrawn at any time.
- For the use of Google Analytics and similar technologies for analytical or measurement purposes: the User’s consent, where legally required.
- Withdrawal of consent shall not affect the lawfulness of processing carried out prior to such withdrawal. Where processing is based on different purposes, the consents granted shall be independent from one another.
TO WHOM WILL THE USER’S DATA BE DISCLOSED?
The User’s personal data may be disclosed to third parties where there is a legal obligation to do so, as well as to service providers acting as data processors and necessary for the provision of the service, such as hosting providers, technology development providers, analytics providers, email service providers, customer support providers, payment gateways, or other auxiliary services.
Some of these providers may be located outside the European Economic Area. In such cases, FiextApp shall adopt the appropriate safeguards required by applicable regulations to legitimize the international transfer of data, such as the European Commission’s standard contractual clauses or other valid mechanisms.
- Guarantees that they are over 14 years of age, or the equivalent minimum age in their country of residence to consent on their own to the processing of their data, and that the data provided to FiextApp are true, accurate, complete, and up to date. In the case of users under 18 but over 14, registration and use of the App is carried out under their own consent, without prejudice to the fact that access to certain events or the purchase of certain tickets may be restricted by applicable legal regulations concerning minors and public entertainment or by the specific conditions of the event organizer. For these purposes, the User is responsible for the truthfulness of all data communicated and will keep the information provided duly updated so that it reflects their actual situation.
- Guarantees that they have informed any third parties whose data they provide, where applicable, of the matters contained in this document. They also guarantee that they have obtained their authorization to provide their data to FiextApp for the stated purposes.
- Shall be responsible for any false or inaccurate information provided through the Website and for any direct or indirect damages caused thereby to FiextApp or to third parties.
- The User guarantees that, when publishing photographs or other content:
- They own the rights to such content or have authorization from the rights holder.
- When photos include other people, they have obtained their consent for publication in the App.
- They do not publish content that infringes the rights of third parties, laws, or regulations.
If the User wishes to stop receiving commercial or promotional communications from FiextApp, they may unsubscribe by sending an email to the following address: info@fiextapp.com
EXERCISE OF RIGHTS
The User may send a written request to info@fiextapp.com to exercise their rights of access, rectification, erasure, objection, restriction of processing, portability, and the right not to be subject to automated individual decision-making, where applicable. FiextApp will respond to the request within the time limits established by applicable regulations.
To delete their account and the data associated with it, the User may:
- Option 1: From the AppDelete their account directly from the application’s Settings / Privacy section.
- Option 2: From the web (by email)Send an email to info@fiextapp.com from the email address registered to their account, with the subject “Account deletion request” and confirming their intention to delete the account.
The user may also file a complaint with the Spanish Data Protection Agency (AEPD) or the competent data protection authority in their country.
WEBSITE AND APP USAGE ANALYSIS
FiextApp uses Google Analytics and, where applicable, similar technologies for statistical purposes and to analyze the use of the Website and the App, in order to understand how users interact with the content and functionalities, improve the user experience, optimize the services offered, and detect possible errors or technical issues.
To the extent legally required, the processing of personal data associated with such analysis shall be based on the User’s consent, which may be withdrawn at any time without affecting the lawfulness of processing carried out prior to such withdrawal.
Google Analytics may involve the use of online identifiers, cookies, or equivalent technologies, as well as the possible disclosure of data to technology providers acting as data processors.
