1. Purpose of the Service

FiextApp is a platform that includes:

  • a website located at https://fiextapp.com (hereinafter, the “Website”);
  • a mobile application available for iOS and Android devices (hereinafter, the “App”).

The platform allows users to buy and manage tickets for events, register as a company interested in the services, and, for users registered in the App, access specific functionalities such as buying and managing tickets, creating posts with photographs taken during events, viewing content from other users, and managing their personal account.

These terms and conditions govern access to and use of the App, as well as all services, content, and functionalities available within the platform.

FiextApp acts solely and exclusively as a technology intermediary platform for the search and purchase of tickets. Unless expressly stated otherwise, FiextApp is not the organizer of the events and is not responsible for the event conditions, cancellations, schedule changes, or access control, which in any case are the responsibility of the third-party event organizer.

 

 

2. Acceptance of Terms

By registering with FiextApp and using the App, you fully accept these Terms of Use. If you do not agree with any of the provisions contained herein, you must not use the App.

 

 

3. Access Requirements

To use FiextApp, you must meet the following requirements:

  • Minimum age:
    • To register an account on FiextApp, you must be over 14 years of age, or the equivalent minimum age in your country of residence to validly consent on your own to the processing of your data.
    • In addition, some events or services may require a different minimum age due to legal requirements or the organizer’s conditions. Please review the specific terms of each event to know the applicable minimum age.
  • Legal capacity: You must have the legal capacity to enter into contracts and not be subject to any legal restrictions that prevent you from using the App.
  • Technical requirements: You must have a compatible device (Android or iOS) with a stable internet connection. We reserve the right to modify the minimum technical requirements at any time.
  • Valid information: You must provide truthful, accurate, and up-to-date information in your user profile.

 

 

 

4. Account Registration

4.1 Account creation

To use the App’s features, you must create a user account by providing your name, valid email address, and any other information requested in the registration form within the App.
Companies interested in FiextApp’s services may register through the contact form on the Website.

4.2 User responsibility

You are fully responsible for all information you provide during registration and for keeping it updated.
You are responsible for maintaining the confidentiality of your access credentials (username and password).
You are responsible for all activities carried out under your account.
You must notify us immediately if you suspect your account has been compromised or used without authorization.
You are not allowed to use your account to impersonate another person or to pretend to be someone you are not. Any attempt at identity impersonation will result in the immediate cancellation of your account, with no possibility of recovery.

4.3 Account security

Do not share your password with third parties. FiextApp will never ask you for your password by email or direct message. If you receive such requests, ignore them and notify the security team at info@fiextapp.com.

 

 

 

 

5. User Obligations

The user agrees to:

5.1 Lawful and legitimate use

  • Use FiextApp only for lawful purposes and in accordance with all applicable laws.
  • Do not use the App for illegal, fraudulent, or rights-infringing activities.
  • Do not engage in harassment, intimidation, impersonation, or defamation.
  • Do not create offensive, discriminatory, violent, pornographic, obscene, hateful, or violent content.

5.2 Protection of technical integrity

  • Do not attempt to gain unauthorized access to the App, servers, systems, or data.
  • Do not carry out SQL injection attacks, denial-of-service attacks (DDoS), malware, or any other form of intrusion or computer sabotage.
  • Do not attempt to bypass security measures or access restrictions.
  • Do not interfere with the normal operation of the App or servers.

5.3 Restrictions on the API and business use

  • You may not create, develop, or distribute parallel, alternative, or complementary software that connects to FiextApp’s API without express written authorization.
  • You may not use the API for purposes other than those authorized.
  • You may not commercialize, resell, or redistribute access to the API without explicit permission.
  • Ticketing companies and similar platforms may not use FiextApp for the purpose of reverse engineering, replicating features, or extracting technical information from the App to develop competing products or services.

5.4 General prohibitions

  • Do not create multiple accounts to bypass restrictions or terms of service.
  • Do not use bots, automated scripts, or scraping tools to extract data from the platform.
  • Do not send spam, mass messages, or unsolicited promotional content.
  • Do not engage in abusive, harassing, or threatening behavior toward other users.

5.5 Compliance with Policies

  • You agree to comply with our Privacy Policy and Cookie Policy.
  • You agree to respect the intellectual property rights of FiextApp and other users.

5.6 User-generated content

  • When you post photographs or other content in the App:
  • You must own the rights to such content or have authorization from the rights holder.
  • When photos include other people, you must have obtained their consent for publication in the App.
  • You must not post content that infringes third-party rights, laws, or regulations.
  • FiextApp may remove, without prior notice, any content that violates these terms.
  • You are responsible for any damages your content may cause to FiextApp or to third parties.

 

 

 

 

 

6. Intellectual Property

6.1 Rights in FiextApp

All intellectual property rights, including but not limited to:

  • source code, algorithms, and technical architecture;
  • design, user interface, and user experience;
  • logos, names, and trademarks;
  • editorial content, text, images, and graphics;
  • functionalities and features;

are the exclusive property of FiextApp or its authorized providers. They are protected by copyright, trademark law, and other intellectual property laws.

6.2 Prohibitions

You may not:

  • copy, reproduce, modify, or distribute any FiextApp content without authorization;
  • use our logos, names, or trademarks without explicit permission;
  • create derivative works from the App without consent;
  • register domains or accounts that imitate our brand.

 

 

7. License of Use

We grant you a non-exclusive, non-transferable, and revocable license to use FiextApp in accordance with these Terms of Use.

This means that:

  • you have the right to use the App for personal, non-commercial use;
  • you do not own the App or its content;
  • the license may be revoked at any time if you breach these terms;
  • you may not assign, sell, lease, or transfer your license to third parties.

 

 

8. Limitation of Liability

FiextApp does not guarantee:

  • Continuous availability: Although we make every effort to keep the service available 24/7, the App may be temporarily unavailable due to maintenance, updates, or technical issues.
  • Service quality: FiextApp strives to ensure the platform functions correctly and at an appropriate quality level. However, we cannot guarantee that the service will be error-free or completely uninterrupted. If you detect any error, technical issue, or unexpected behavior, we encourage you to report it using the contact form available in the App or on the Website. Your feedback helps us improve.
  • Data loss: We are not responsible for data loss caused by:
    • voluntary deletion by the user;
    • technical or hardware failures on your device;
    • unstable internet connections;
    • any other cause beyond our reasonable control.
  • Service interruptions: We are not responsible for interruptions caused by external factors (third-party server outages, connectivity issues, etc.).

To the extent permitted by law, FiextApp shall not be liable for indirect, incidental, special, or consequential damages arising from the use of or inability to use the App.

 

 

 

 

9. Privacy and Data Protection

The processing of your personal data is governed by our Privacy Policy, which forms an integral part of these Terms of Use.

10. Account Suspension and Termination

10.1 Suspension or closure for non-compliance

FiextApp reserves the right to immediately suspend or close your account if:

  • you breach these Terms of Use;
  • you engage in illegal or harmful activities;
  • you attempt to impersonate another person;
  • you carry out SQL injection attacks or other cyberattacks;
  • you use the API without authorization or for prohibited purposes;
  • you create multiple accounts to circumvent restrictions;
  • you engage in abusive, harassing, or threatening behavior;
  • you breach other policies or community rules.

10.2 Effects of termination

When an account is closed or suspended:

  • you lose access to your account and content;
  • data associated with your account will be processed in accordance with the Privacy Policy;
  • some data may be retained due to legal obligations;
  • your account cannot be recovered.

 

 

11. Account Deletion

11.1 How to request deletion

To delete your FiextApp account, you may choose one of the following options:

  • Option 1: From the App
    Delete your account directly from the App’s Settings / Privacy section.
  • Option 2: From the web (by email)
    • Send an email to info@fiextapp.com from the email address registered to your account.
    • In the subject line, write: “Account deletion request”.
    • In the body of the email, include your name and confirm that you wish to delete your account.

11.2 Requirements and validation

  • The request must come from the email address registered to the account.
  • An account cannot be deleted on behalf of another person.
  • You will receive a confirmation email before deletion proceeds.
  • You will have 7 days to confirm the deletion. This email confirmation requirement will apply only to requests made through Option 2 by email, whereas direct deletion applies when executed from the App itself.

11.3 Deletion process

  • Once confirmed, we will proceed to delete your account and associated personal data.
  • The process will be completed within a maximum of 30 days.
  • Some data may be retained for legal or regulatory obligations.
  • Deletion is permanent and irreversible.

11.4 User responsibility

  • Any content you voluntarily deleted before requesting account deletion cannot be recovered.
  • We are not responsible for data loss caused by your deletion request.

 

 

12. Changes to the Terms

FiextApp reserves the right to modify these Terms of Use at any time to reflect legal changes or technical improvements. The changes will be communicated to users through the App or by email at least 15 days before they take effect. If the User does not agree with the new terms, they may close their account free of charge before the changes take effect. Continued use of the platform after that period will imply acceptance of the new terms.

Your responsibility:

  • Review these terms periodically
  • Continued use of the App after the changes means you accept the new terms
  • If you do not accept the changes, you must stop using the App

 

 

13. Disclaimer of Warranties

FiextApp is provided “as is” and “as available”.

We do not guarantee:

  • that the App is suitable for your specific needs;
  • that the service will be uninterrupted, timely, or error-free;
  • that defects in the App will be corrected;
  • that the App will be compatible with all devices or operating system versions.

To the fullest extent permitted by law:

  • we disclaim all other warranties, express or implied;
  • we are not liable for incidental, indirect, special, or consequential damages.

 

 

14. Governing Law and Jurisdiction

14.1 Governing law

These Terms of Use are governed by and shall be interpreted in accordance with the laws of Spain, without regard to its conflict of law provisions.

14.2 Dispute resolution

For users residing in Spain, any controversy, dispute, or claim arising from or related to these Terms of Use or the use of FiextApp…

For users who qualify as consumers under Spanish law, any controversy or dispute related to these Terms of Use shall be submitted to the courts and tribunals of the user’s place of residence. In the case of a dispute with a professional user or company, both parties submit, expressly waiving any other jurisdiction, to the courts and tribunals of Badajoz, Spain.

For users residing outside Spain, disputes shall be resolved in accordance with the law applicable in their country of residence, without prejudice to the rights granted to consumers under local law.

14.3 Regulatory compliance

These Terms of Use comply with:

  • the General Law for the Protection of Consumers and Users;
  • the Personal Data Protection Law (GDPR);
  • the Information Society Services Act (LSSI-CE);
  • all applicable e-commerce laws in Spain.
